Description of related technologies

• Log Files: Automatically generated logs created when visiting the website. They contain information such as IP address, browser used, pages accessed, time of access, and possibly error messages. These data serve error analysis, system security, and statistical evaluation.
• Web Beacons / Tags / Pixels: Small invisible image files or code snippets embedded in websites or emails. They enable the collection of information such as whether and when a page was visited or an email was opened. They are used, for example, for analytics or to measure the success of marketing campaigns.

These technologies help us optimize our offerings, display personalized content, and target marketing measures more effectively. Processing only occurs with your explicit consent. You can revoke this consent at any time.

B.    User Information

When you create a user account, we also store the required user data that you voluntarily provide (name, email, and password). You can instruct us to delete your user account at any time. We will use the data you provide to fulfill and process your order. When you make or attempt to make a purchase through the website, we collect certain information from you, including your name, your company (optional), your billing address, your shipping address, your payment information (including credit card numbers, email address, and phone number). We refer to this information as "Order Information." When we mention "Personal Information" in this privacy policy, we mean both device and order information.

C.   Payment service providers

Please note that we use the payment service provider PayPal. The provider of this payment service is PayPal (Europe) S.à.r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg (hereinafter referred to as "PayPal"). If you choose to pay via this payment provider, the payment data you provide will be forwarded to the payment provider in accordance with Art. 6, paragraph 1(f) of the GDPR. It is considered a legitimate interest to offer our customers a wide range of convenient payment options. Additionally, we use the service provider Klarna. We offer you payment options including "Klarna Invoice" and "Klarna Installment Purchase". These services are provided by Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden ("Klarna").

If you choose one of these payment options, we transmit the personal data necessary for contract processing (e.g., first and last name, address, date of birth, gender, email address, IP address, phone number, as well as order data such as number of items, item number, invoice amount, and taxes) to Klarna. The data transmission is carried out exclusively to enable payment processing and to conduct an identity and creditworthiness check by Klarna.

Note: The identity and creditworthiness check is carried out exclusively by Klarna itself. NEOH does not perform any creditworthiness check itself and does not receive any insight into its results.

Klarna processes the received personal data independently within the scope of the decision on the acceptance of the payment option (e.g., purchase on account). For this purpose, Klarna may exchange data with credit agencies, use information about your previous payment behavior, and calculate so-called score values based on a scientifically recognized, mathematical-statistical procedure. Klarna may also use address data for this.

Legal basis for data processing by Klarna is Art. 6 para. 1 lit. b GDPR (contract performance) as well as Art. 6 para. 1 lit. f GDPR (Klarna's legitimate interest in creditworthiness check).

A data processing agreement according to Art. 28 GDPR has been concluded with PostPal Marketing Solutions GmbH. This ensures that your data is only used within the scope of the commissioned order, adequately protected, and not disclosed to unauthorized third parties.

You can object to the use of your data for postal direct advertising purposes at any time. Please send an informal message to support@neoh.com.

Based on our legitimate interest in personalized direct advertising according to Art. 6 para. 1 lit. f GDPR, we pass on certain customer information (name, address data) received from you within the contractual relationship to the provider and commission them with printing and postal delivery of interest-based advertising information about our offers as part of individual campaigns. You can object to the storage and use of your data for postal direct advertising purposes at any time. We have concluded a data processing agreement with the provider that ensures the protection of our site visitors' data and prohibits unauthorized disclosure to third parties.

Use of phone numbers: According to Art. 6 para. 1 lit. a GDPR, with your consent, personal data (name and first name, phone number, Messenger ID, IP address, profile picture, and message history) are stored, processed, and used within the scope of using the respective WhatsApp, SMS, or Messenger service to send messages to you. Consent for the WhatsApp/Messenger service is given independently of the newsletter in a separate double opt-in procedure. An active account with the respective provider is required to use the Messenger service. The provision of this service is carried out by the company GmbH, A-3400 Klosterneuburg, as a technical service provider and processor. Your consent to the processing of personal data can be revoked at any time; a corresponding notification to our support or Chatarmin is sufficient. For sending direct messages and communication via messenger services, we use the service Chatarmin.com GmbH, Mühlgasse 59/6, 3400 Klosterneuburg, Austria, as a technical service provider and processor according to Art. 28 GDPR.

If you actively register via our website, as part of campaigns, or through other contact forms to receive messages via WhatsApp, SMS, or push notifications, we process the following personal data depending on the service used:

The processing of this data is carried out exclusively for the purpose of conducting the desired communication, processing your inquiries, and for marketing and informational purposes, provided you have expressly consented beforehand. The legal basis is your consent according to Art. 6 para. 1 lit. a GDPR.

Your consent can be revoked at any time with effect for the future – either directly in the respective messenger (e.g., via a "Stop" command) or by notifying us via email at support@neoh.com. After a revocation, you will no longer receive messages via this channel, and your data will be deleted – subject to legal retention obligations.

The technical processing and storage of messages takes place on servers of Chatarmin within the EU. A data processing agreement according to Art. 28 GDPR has been concluded and ensures the data protection-compliant processing of your data.

To continuously improve your shopping experience and protect you from unnecessary advertising, we use the information you provide and automatically generated information to create individual advertising tailored to you and your interests. We only use information in pseudonymized form, such as delivery and read receipts of emails, your order history, date and time of visits to the homepage, product pages you have visited. The analysis and evaluation of this information enables us to send you individual advertising. Our goal is to make our advertising more useful and interesting for you. We want to prevent random advertising and only send you advertising, for example in the form of newsletters, product recommendations in emails, direct mail, or package inserts, that corresponds to your interests. If you do not want to receive individual advertising, you can object at any time overall or for specific measures. A notification in text form to the contact details listed in section 8 (e.g., email, letter) is sufficient.

The processing is based on Art. 6 para. 1 lit. a GDPR. We store your data as long as you do not revoke your consent.

D.   Communication

You have the option to exchange information with us via email. The processing of message content and contact data is for the purpose of initiating contractual relationships. If your contact has another reason, the processing is carried out to protect your or our legitimate interest in freedom of communication. If you do not want to provide or disclose information, we ask you not to contact us by email.

We store your contact data for a maximum of 24 months after the last communication on the same matter. We use a service provider to operate our email mailboxes.

SECTION 3 - DISCLOSURE OF YOUR DATA & DATA PROCESSING

We share your data with third parties to assist us in using your personal data as described above.

1. Shop operation with Shopify

We use the e-commerce platform Shopify International Limited, 2nd Floor, 1-2 Victoria Buildings, Haddington Road, Dublin 4, D04 XN32, Ireland, to provide our online shop.

During your visit to our website and when placing orders, personal data is processed via Shopify. This includes in particular:

·       Email address

·       Delivery and billing address

·       Payment information (e.g. credit card number, payment provider)

·       IP address

·       Information about the products you purchased

·       Device data (e.g. browser, operating system, screen resolution)

Shopify provides the technical infrastructure for our online shop, processes the mentioned data exclusively on our instructions and only to the extent necessary for the operation of the shop and the processing of orders.

The processing is based on Art. 6 para. 1 lit. b GDPR (contract fulfillment) as well as – in the case of security-relevant and analytical purposes – Art. 6 para. 1 lit. f GDPR (legitimate interest in a secure and functional online shop).

Shopify acts as a processor within the meaning of Art. 28 GDPR. A corresponding data processing agreement has been concluded. Shopify's servers are partly located in Canada and the USA. Canada is considered data protection safe according to an adequacy decision by the European Commission. For data transfers to the USA, Shopify relies on the EU standard contractual clauses according to Art. 46 para. 2 lit. c GDPR.

You can request information about the data stored about you at any time and assert your rights to correction, deletion, restriction of processing, or objection. Please contact support@neoh.com for this.

 2. Shipping service providers / logistics

To process and deliver your order, we transmit necessary shipping data (name, address, if applicable phone number) to the following service providers:

3. Analysis and reach measurement

We use web analytics and marketing services to optimize our website and advertising measures. Processing only takes place with your prior consent (Art. 6 para. 1 lit. a GDPR), which you can revoke at any time.

a) Google Analytics (USA)

Google Analytics is a web analytics service from Google LLC, 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA. Information about your usage behavior, IP address, device data, and session duration is processed. Google acts as our data processor. Data transfer to the USA is based on EU standard contractual clauses.

b) Meta (Facebook/Instagram) Remarketing (USA)

We use Meta Pixel technology to analyze and optimize our advertising on Facebook and Instagram. Meta Platforms Inc., 1601 Willow Road, Menlo Park, CA 94025, USA, receives pseudonymized user data (e.g., IP address, device information, visited pages). No direct identification takes place.

c) Google Ads Conversion Tracking (USA)

We use Google Ads Conversion Tracking to identify which ads have led to a purchase. A cookie is stored on your device. Pseudonymized data about your use of our site is transmitted to Google.

d) Pinterest Ads (Ireland/USA)

Pinterest Ads allows personalized ads to be displayed on Pinterest. For this purpose, user behavior on our website is analyzed and processed. Provider: Pinterest Europe Ltd., Palmerston House, 2nd Floor, Fenian Street, Dublin 2, Ireland. In part, data is also transferred to the USA.

e) LinkedIn Insight Tag (USA)

The LinkedIn Insight Tag collects information about visits to our website (e.g., referrer URL, IP address, device information) to analyze the effectiveness of LinkedIn campaigns. Provider: LinkedIn Ireland Unlimited Company, Wilton Place, Dublin 2, Ireland. Data transfers to the USA are based on standard contractual clauses.

f) Amazon Ads (Luxembourg/USA)

Amazon Ads uses cookies to determine whether users have completed a purchase after clicking on an ad. The provider is Amazon Europe Core S.à.r.l., 5 Rue Plaetis, L-2338 Luxembourg. Data transfers to third countries are also based on appropriate safeguards.

During registration, the required data is entered into an input form, transmitted to us, and stored. We use the so-called double opt-in procedure, meaning your account is only created once you confirm a confirmation email sent to you for this purpose by clicking the link contained therein. This is to ensure that only you yourself can register as the owner of the specified email address. Your confirmation must be made promptly after receiving the confirmation email; otherwise, your registration will be automatically deleted from our database. After your initial login, we also offer you the so-called "Remember Me" function to recognize your account.

We collect additional data during your membership when you use your account and our services. We process the following personal data:

We process your date of birth to verify the minimum age required for participation in the NEOH Bonus Club in individual cases, as well as to offer you additional benefits from the club if applicable. Furthermore, you will receive information necessary for participation in the NEOH Bonus Club, such as a registration confirmation, updated terms and conditions, and information about the benefits granted through the NEOH Bonus Club.

If you have given us your consent, we will send you information tailored to your interests about interesting offers, current promotions, products, services, quizzes, challenges, and sweepstakes at regular intervals via email, SMS, MMS, push notifications, messages via apps and messengers, as well as by mail. In addition, we may contact you for customer surveys (e.g., Post-Purchase Surveys and Customer Satisfaction Enquiries) and within the scope of customer care (e.g., reminders, messages about product availability), invite you to submit reviews, and wish you a happy birthday. The processing of personal data is voluntary based on your consent according to Art 6 para 1 lit a GDPR. The data will be deleted as soon as they are no longer necessary for the purpose for which they were collected.

Membership in the NEOH Bonus Club and consent to the processing of personal data can be withdrawn at any time free of charge without giving reasons by email to support@neoh.com can be revoked. In this case, your account will be deleted and you will no longer be able to enjoy the benefits. A (further) membership in the NEOH Club is not (any longer) possible if you do not give or revoke your consent. In addition, your consent to be contacted for the purposes described above can be separately revoked via the unsubscribe link in the respective message. In this case, your membership in the club remains valid and your account remains. You can continue to collect points when shopping and in selected other activities and redeem them for orders, as well as manage your addresses and view purchase and order history. However, you will no longer receive advertising messages from us. In both cases, the revocation does not affect the lawfulness of the processing up to the point of revocation. After revocation of consent, the personal data will be deleted.
